Marathon Rules and Regulations, 22.04.2018 r. (hereinafter: "Rules and Regulations")

  1. EVENT OBJECTIVES

    1. Popularization and promotion of running as the simplest form of athletic activity.
    2. Promotion of the city of Warsaw in Poland and worldwide.
    3. Promotion of the ORLEN brand as the Marathon's title sponsor.
  2. MARATHON ORGANIZER

    The Organizer of the ORLEN Warsaw Marathon (hereinafter also "OWM”), part of which is the marathon with a distance of 42.195 km (hereinafter: "Marathon”), is ”MyPlaceSpółka z ograniczoną odpowiedzialnością with its registered office in Warsaw, at ul. Młynarska 42, 01-171 Warsaw, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the capital city of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, as KRS number: 0000274560, NIP [tax identification number]: 7010053450, REGON [state statistical number]: 140858208, with a share capital of: PLN 300,000.00 – hereinafter referred to as "Organizer”.

    The administrator of personal data processed in connection with the organization of ORLEN Warsaw Marathon, within the meaning of the Act dated 29 August 1997  on the protection of personal data (uniform text: Journal of Laws of 2016, item 922 as amended), is Polski Koncern  Naftowy  ORLEN  S.A. with its registered office in Płock, 09-411 Płock, ul. Chemików 7 (hereinafter: “Personal Data Administrator” or “PKN ORLEN S.A.”), which, pursuant to Art. 31 of the foregoing Act, entrusts the processing of personal data to the Organizer with the purpose of organizing the OWM, including the Marathon.

    Submission of personal data is voluntary but necessary for participation in ORLEN Warsaw Marathon, as per the provisions of the present Rules and Regulations. All persons who submit their personal data shall be entitled to access their data, correct it and to withdraw their agreement for the processing of data at any point in time.  The Organizer may process personal data in connection with the organization of the ORLEN Warsaw Marathon in collaboration with other entities, solely to the extent reqired for the proper organization of the OWM, including the Marathon.

  3. DATE AND VENUE

    1. The Marathon will take place on 22.04.2018 in Warsaw.
    2. Venue, start time and the detailed Marathon course will be available at the ORLEN Warsaw Marathon webpage at: www.orlenmarathon.pl (hereinafter: "Webpage").
    3. Only persons who satisfy the requirements set out in the present Rules and Regulations may participate in the Marathon, and all participants must register pursuant to the provisions of the present Rules and Regulations (hereinafter: "Participants").
    4. The Organizer reserves the right to change the date and/or venue of the Marathon whereas such necessity arises for reasons not attributable to the Organizer (in particular due to force majeure), of which the Participants shall be notified by way of relevant information posted on the Webpage no later than 24 hours prior to the Marathon start, and via e-mail. In the event indicated in the present paragraph, each Participant who is not interested in participating in the Marathon in the new venue or on the new date, should notify the Organizer thereof by way of an e-mail message to [email protected], no later than within 3 (three) days from receiving the foregoing e-mail notification from the Organizer. In the event indicated in the preceding sentence, the Organizer shall reimburse the entry fee within 14 (fourteen) days from the date of receipt of the aforementioned notification, to the bank account from which payment has been made. The Organizer shall not be obliged to reimburse Participants with entry fees in the event of the Participant having picked up their start kit and not returning it to the Organizer's Race Office prior to the commencement of the Marathon on the new date or in the new venue (even if the Participant has sent in their notification), as well as in the event of the Participant actually taking part in the Marathon in spite of having given the aforesaid notification.
    5. The Marathon course distance is 42.195 km (hereinafter: "Course").
    6. All the kilometres on the Marathon Course shall be marked.
    7. Participants must line up at the start corrals in the following order:
      1. Participants with bib numbers assigned to their names (separate zone),
      2. All other Participants line up in the zones indicated by the Organizer. Assignment to a given zone takes place based on the finish times declared in the registration form, pursuant to Art. 8 below.
    8. At registration (i.e. in the registration form), each Participant must declare their starting zone mentioned in Art. 7 point b) above, as per their actual running capacities. Starting zones may be changed up until 15.04.2018 by way of modifying the Participant's information on the Webpage. Failure to indicate the starting zone on the the Participant's bib number shall result in the Participant being moved to the last starting zone.
    9. Only Marathon Participants, Marathon staff and persons/vehicles with a pass issued by the Organizer may enter the Marathon Course.
    10. During the Marathon, all Participants must have a chip on them, which will be mounted on the bib number of each Participant. The chip may not be removed from the bib number. If the chip is removed or lost, the Participant's classification will not be possible.
  4. TIME LIMIT AND CONTROLS

    1. The time limit for the race is 05h:30min:00s, counted from the starter shot (gross time).
    2. There will be time measurement checkpoints set up every 5 kilometres on the Marathon Course with a clock displaying the official race time (counting from the starter shot) The checkpoint marshals will record the bib numbers of all Participants who shorten the Course. Participants who shorten the Course shall be disqualified.
    3. The organizer has introduced limits of control times at individual checkpoints (every 5th kilometer starting from the 20th kilometer). A maximum time limit, counted from the race start (i.e. starter shot) will be set up for each checkpoint, and Participants must pass the checkpoints within the maximum time allowed. In the event of exceeding the time limit, Participants will be requested to get off the Course and will not be classified. The Organizer shall notify Participants of the time limits assigned to each checkpoint via the Webpage.
    4. Participants who do not make it to the individual checkpoints specified under par. 3 above within the assigned time limit (starting from the 20th kilometer) will be obliged to stop the Marathon, get off the Course and get to the finish line on the bus marked with the sign END OF RACE. Participants who arrive at the finish line by bus will not be classified by the Organizer. In such event, the Webpage will display the message "NUM" instead of the Participant's time, meaning: "has not finished the marathon".
    5. Participants who remain on the Course upon the lapse of the time limit (mentioned under par.  1 and 2 above), or in contravention of par. 4 above, do so at their own risk and responsibility, subject to the binding traffic regulations and the Civil Code. In the event specified in the preceding sentence, the Organizer shall not be liable for any bodily harm or health damage of these Participants.
  5. FOOD AND FLUID STATIONS, MEDICAL AID

    1. Fluid stations will be available every 5 km, starting from kilometre 7.5 of the Course.
    2. Food stations will be available every 5 km, starting from the 5th kilometre of the Course.
    3. The Organizer does not accept Participant's private energy gels, except for the Participants whose bib numbers are assigned to their names (the "Elite" Group).
    4. Medical aid stations will be located near the food stations and will be staffed by paramedics. Latrines will be located behind the medical aid stations.
  6. PARTICIPATION

    1. The Marathon is an open event. Participants of the Marathon must be at least 18 years of age. on 22.04.2018 and meet the requirements set out below:
    2. In order to run the Marathon, a Participant  must:
      1. fill out the registration form, pursuant to the provisions of Ch. 7 of the Rules and Regulations,
      2. consent to observing the present Rules and Regulations, as well as the IAAF (International Association of Athletics Federations) regulations and the PZLA (Polish Athletic Association) regulations available at http://ckspzla.pl/cksdokumenty/index.html,
      3. accept participation in the Marathon at their own responsibility, with account for the hazards and risks resulting from the nature and length of the Marathon, which may result, among others, in the risk of loss of life or injury. Only persons in good health, who have no counter-indications to participating in a marathon race should participate in the Marathon.
      4. give separate consent to processing the Participant's personal data as submitted in the registration form specified under point a) above and submit Participant's health statement to the effect that the Participant's health condition allows him/her to run the Marathon, as well as consent to placement of personal data (first and last name, gender, birth year, nationality and personal image) in TV, radio and Internet broadcasts, in printed form and for the Organizer to send to the e-mail address indicated by the Participant the organization information concerning ORLEN Warsaw Marathon, as well as - optionally - information  concerning the promotion and marketing of PKN ORLEN S.A. products and services. A template of the consent form for the processing of personal data and use of personal image is Attachment no. 1 to the Rules and Regulations. Participant's personal data may be transferred to entities collaborating with the Personal Data Administrator and with the Organizer in the ORLEN Warsaw Marathon and related activities, based on data processing agreement, pursuant to Art.. 31 of the Act dated 29 August 1997 on the protection of personal data (uniform text: Journal of Laws of 2017, item 922 as amended),
      5. give consent to free-of-charge use of the Participant's personal image captured as a photograph, video or audio-video recording. The Participant hereby grants PKN ORLEN S.A. and the Organizer a worldwide licence, unlimited in time, to use his/her captured personal image in the following areas:
        1. capturing and reproduction, by any known technology, and publication in any form,
        2. making available to sponsors and official partners copies of the captured image, with a purpose of using it for the promotion of the official partner within the scope of its participation in the ORLEN Warsaw Marathon,
        3. inputting in computer memory and multimedia networks,
        4. reproduction of the captured image,
        5. public showing, displaying, broadcasting and re-broadcasting of the Participan't image, as well as making it available to the public in a way allowing anyone to access it at the time and place chosen,
        6. placement and publication in press, on Internet pages, posters and billboards,
        7. broadcasting on television and  radio,
        8. publication of the Participant's photographs from participation in the Marathon in the form of photos from the Marathon course (link to photos and video materials will be placed next to the name of the Participant).
      6. submission to verification at the Race Office on 19-21.04.2018, pursuant to the provisions of par. 4 below of the present  Rules and Regulations.
    3. The Organizer and PKN ORLEN S.A. shall be entitled to grant sub-licenses to official partners and sponsors or ORLEN Warsaw Marathon for the use of the captured Participant image, specified under par. 2 above, within the extent of the licence granted to them.
    4. Pick-up of start kits will take place during verification, based on:
      1. in case of Participants who pick up their start kits on their own – presented valid ID with photo,
      2. in case of Participants whose start kits are picked up by a third person – presented written authorization of the Participant for the Participant's start kit to be picked up by a third person, along with the presented valid photo ID of the person authorized for the pick up. Consent form template is Attachment no. 2 to the Rules and Regulations. It is also available on the Webpage ("For Participants" tab).
    5. The pick-up of start kits can only take place pursuant to the rules set out herein. There is no option of sending the start kits to Participant's address.
    6. Start kits will be issued from 19.04.2018 to 21.04.2018 at the Race Office, in the Office work hours.  The Race Office will be located at the ORLEN Warsaw Marathon venue, in the Runners' Village. The Organizer will notify the Participants of the exact location and work hours of the Race Office via the Webpage, no later than 4 (four) days prior to the start of Marathon. Start kits cannot be picked up on the day of the Marathon.
    7. Prior to the Marathon, all Participants will be able to use a changing room. After the Marathon, all Participants will be able to use a changing room and wash stations. They will be located near the Runners' Village. The Organizer will notify the Participants of the exact location of the changing rooms via the Webpage, no later than 3 (three) days prior to the start of Marathon.
    8. Participants may deposit their personal belongings, placed in marked bags that are part of the starting kit. The pick-up of personal belongings from the deposit will be possible upon presentation of the Participant's bib number. In the event of loss of the bib number, the Organizer shall not be held responsible for the pick-up of Participant's personal belongings by another person.
    9. The Organizer shall not be held responsible for Participants' belongings left on the Marathon Course or in the Runners' Village during the Marathon, if they are not placed in deposit specified under par. 8 above.
    10. Participants must observe public order, instructions of security staff, marshals and representative of the Organizer, as well as respect all other Marathon Participants in the spirit of sportsmanship and rules of fair-play. The Organizer may refuse the right of participation in the Marathon, and may remove from the Marathon venue, all persons disturbing public order, the course of the Marathon, disobeying the instructions of persons indicated in the preceding sentence or breaching the Rules and Regulations or the regulations of IAAF or PZLA.
    11. During the Marathon, all Participants must have their bib numbers secured to the front of their bib. Covering up the bib number, fully or partially, will result in Participant's disqualification.
  7. REGISTRATION

    1. Registrations are accepted:
      1. until 15.04.2018 - by way of submission of the registration form available on the Webpage;
      2. on 19-21.04.2018 - exclusively at the Race Office, in its work hours, by way of submission of a registration form. The deadline for submission of registration forms is 21.04.2018.
    2. The Organizer sets the total limit of bib numbers at 8.000 (eight thousand). Once the limit specified in the preceding sentence runs out, registrations will not be accepted. The guaranteed "Basic" starter kit will be issued to Participants who pay for their registration before the limit of 2.000 (two thousand) runs out, the guaranteed "Premium" starter kit will be issued to Participants who pay for their registration (or are exempted from the fee) before the limit of 3.000 (three thousand) runs out. Once the limit of start kits runs out, it will not be possible to register at the Race Office. Order of registration and payments decides on the participation in the Marathon. Date and time of crediting the Organizer's bank account, or the date and time of paying the fee at the Race Office, will be deemed the payment time.
    3. The following Participants are entitled to start kit "basic" fee exemptions, provided they register by 15.04.2018:
      1. Participants over 70 years  of age (based on a photo ID);
      2. handicapped Participants (based on a medical certificate  of handicap);
      3. Participants who hold valid sports category 2 in marathon as per the classification of PLZA, achieved in 2017 or 2018;
      4. Participants exempted from the start kit fee by the organization committee appointed by the Organizers, whose members will be listed on the webpage at www.orlenmarathon.pl (hereinafter: "Organization Committee") (based on documents indicated by the Organization Committee.).
    4. In the event of registering at the Race Office, the start kit exemption specified under par. 3 above does not apply.
    5. In order to register, a Participant must submit the Marathon registration form via the Webpage or at the Race Office and pay the start kit fee to the Organizer's bank account (if registering via the Webpage), or pay in cash or by bank card (if registering at the Race Office).
    6. The start kit fee, at the amount payable in the given period as per par. 7, will go toward covering the costs of organization of the Marathon.
    7. The start kit fees are as follows:
      1. until 21 March 2018:
        • PLN 59.00 – "basic” kit (participation in the Marathon and a bib number),
        • PLN 89.00 "standard” kit (participation in the Marathon, bib number and t-shirt – while supplies last),
        • PLN 119.00 – "premium”  kit (participation in the Marathon, bib number, t-shirt and sport accessory – while supplies last),
      2. from 22 March 2018 to 15 April  2018:
        • PLN 69.00 – "basic” kit (participation in the Marathon and a bib number),
        • PLN 99.00 "standard” kit (participation in the Marathon, bib number and t-shirt– while supplies last),
        • PLN 129.00 – "premium”  kit (participation in the Marathon, bib number, t-shirt and sport accessory – while supplies last),
      3. at the Race Office from 19 April 2018 to 21 April 2018:

        if paid for with cash or bank card:

        • PLN 99.00 – "basic" kit (participation in the Marathon and bib number),
        • PLN 149.00 – "standard” kit (participation in the Marathon, bib number, T-shirt - while supplies  last).
    8. Additionally, Participants who register and pay the start kit fee by 31.03.2018 may receive a bib number with their name printed on it.
    9. Persons entitled to start kit fee exemption, specified under par. 3 above, will be exempted from the fee for a start kit “basic” during the registration process. Registration system automatically will set the payment discount. The Organiser will verify the Participant’s eligibility for an exemption when the Participant is collecting their package from the event office. If the Participant meets the eligibility criteria, the Participant Entry Package will be issued. If the Participant doesn’t meet the eligibility criteria for an exemption from the fee, Participant in order to receive the Participation Entry Package, will be obligated to pay the value of the start kit “basic” valid on the day of receipt of the package.
    10. It will not be possible to register or pay the start kit fee on the date of the Marathon
    11. The start kit fee will be reimbursed in the following cases:
      1. if the Marathon is cancelled for reasons attributable to the Organizer, as per the provisions of Ch.  III, par. 4 of the Rules and Regulations,
      2. if the start kit fee is paid after the relevant deadline or after the limit of start kits, specified under par. 2 above has run out,
      3. if a Participant is exempted from the start kit fee, as per par. 3 above, pursuant to the rules specified under par. 9 above.
    12. Except for the cases specified under par. 11 above, a paid start kit fee is not subject to reimbursement.
    13. Properly registered Participants (who have paid for the start kit) cannot change the Marathon to a different race taking place as part of the OWM.
    14. Detailed information concerning the start kit fees, dates and forms of payment are available on the Webpage, under the tab "For Participants".
    15. In the event of making payments that require bank commission or commission of another intermediary institution, Participants must make sure to add the relevant commission amount to the start kit fee. In the event of Participant's failure to pay the commission, as a result of which the payment is suspended or rejected by the bank or another intermediary institution, registration will not be possible.
  8. CLASSIFICATIONS

    1. Participants of the Marathon will be classified as follows:
      1. OPEN classification of women and men,
      2. age classifications of women and men: 18-29, 30-39, 40-49, 50-59, 60-69, 70-79, 80 and over,
      3. 88th Polish Men's Marathon Championship (classification is subject to provisions of the PZLA),
      4. Oldest Female Participant to Complete the Marathon,
      5. Oldest Male Participant to Complete the Marathon,
      6. handicapped: blind with guide and visually impaired,
      7. Polish debut at ORLEN Warsaw Marathon (Participants subject to classification are all those who have not previously run in marathon races organized as part of the former editions of ORLEN Warsaw Marathon).
    2. The basis of classification shall be the electronic time measurement counted by the chip on the bib number of each Participant, with reservation of par. 3 below. Electronic mats will be placed along the course in order to measure interim times of each Participant at a given checkpoint. Participant's failure to show up at a given checkpoint will result in their disqualification.
    3. Classification of Participants in the OPEN category takes place based on gross time for the first 60 Participants (of which 50 men and 10 women) at the finish line. In the age categories specified in par. 1 letter b) above, and in the category specified in par. 1 letter f) above, the classification is based on net times, that is from the moment that the Participant cross the start line. Classification of Participants in the category specified under par. 1 letter g) above is based on the rules applicable to the OPEN category.
    4. Prizes in the age classification are not cumulative with the prizes in the men's and women's OPEN classification.
    5. A Participant who has been classified in places 1 to 10 in the men's and women's OPEN classification (specified under par. 1 letter a above) will not classify for the age classification prize, and his/her prize will go to the next person on the list.

    3. Prizes in the women's OPEN classification (places 1 to 10) and men's OPEN classification (places 1 to 10) go to Participants in the order of crossing the finish line.
    4. All Participants who complete the Marathon within 05h:30min:00s. from the starter shot will receive a commemorative medal.
    5. The value of money prizes will be decreased by the value of income tax as per the effective provisions of law.
    6. Money prizes won by Participants shall be transferred exclusively to the personal bank account indicated by the Participant (not paid out in cash) within 14 (fourteen) days from the date on which the Organizer receives the result of anti-doping tests (if performed, pursuant to the provisions of Ch. X of the Rules and Regulations), but in any case no later than within 45 (forty five) days from the date of completion of the Marathon, with reservation of par. 7 below.
    7. In the event of a Participant winning a money prize, the condition for its transfer onto the bank account, pursuant to par. 6 above, will be to fill out the Participant profile in the electronic registration form, available on the Webpage, to include the account number along with the bank information necessary for transferring the prize amount, or – in the event of registration at the Race Office – to submit a written statement with the bank account, along with the bank information necessary for transferring the prize amount, to the Organizer. A preliminary list of Participants who have won money prizes will be published within 14 (fourteen) days from the date of completion of the Marathon. The final list of Participants who have won money prizes will be published within 14 (fourteen) days from the date of the Organizer receiving the results of anti-doping tests (if performed), but in any case no later than within 45 (forty five) days from the date of completion of the Marathon.
  10. ANTI-DOPING TESTS

    The Organizer is entitled to order the performance of anti-doping tests to an authorized entity,  with Participants for testing chosen at random.

    FINANCING

    1. The costs of the start kit, commute, accommodation and other expenses shall be covered by the Marathon Participants or the organizations who delegate them.
    2. The start kit fee entitles the Participant to run the Marathon. Depending on the chosen start kit ("basic", "standard" or "premium" option, pursuant to Ch. 7 of the Rules and Regulations), a Participant receives the bib number, bib number and t-shirt or bib number, t-shirt and a sports accessory. Ordering the start kits specified in the preceding sentence will take place in the time frame as communicated by the Organizer via the Webpage. The Organizer will use its best efforts to ensure that each Participant who has selected the "standard" or "premium" kit receives the t-shirt size declared in the registration form, but owing to organizational and technical reasons, this cannot be guaranteed.
  11. FINAL PROVISIONS

    1. The Organizer shall provide medical aid at along the Marathon Course and at the finish line, during the Marathon and directly after its completion.
    2. Each Marathon Participant will be covered, for the duration of the race, by the Organizer's civil liability insurance policy on general terms. Individual insurance covering injuries or other fortuitous events that may befall a Participant during the Marathon shall require a separate policy, taken out individually by the Participant.
    3. No person without a valid bib number may be present at the Marathon Course. All persons without a valid bib number will be removed from the Marathon Course by marshals. In particular, it will not be admissible to move along the Marathon Course on wheelchairs (with the exception of Participants taking part in the race of wheelchairs), on handbikes, roller blades, skateboards and other mechanical devices, as well as with animals, barring a previous express consent of the Organizer. It is also inadmissible to use Nordic Walking poles or similar.
    4. Transferring one's bib number to another person, at this person's consent, will result in the disqualification of the Participant and of the person to whom the bib number has been transferred. The right to participate in the Marathon is non-transferable and non-exchangeable for money.
    5. Complaints concerning the organization or results of the Marathon must be directed to the Marathon Organizer (e-mail: [email protected]), within the unconditional deadline of 24 hours from the end of the Marathon. Complaints shall be examined by the Organization Committee, whose decisions are final. Complaints shall be examined within 14 (fourteen) days from the receipt of the complaint by the Organizer. Following the examination of all complaints (or upon the lapse of 24 hours from the end of the Marathon - if none are filed), the Marathon results become official.
    6. The Organizer does not allow for the start kits to be donated for any contests without the prior written consent of the Organizer.
    7. The Organizer reserves the right to amend the present Rules and Regulations, provided that such amendments are not to the detriment of Participants, especially as regards their rights based on the present Rules and Regulations. Any possible later amendments of these Rules and Regulations shall become effective from the date of the publication on the Webpage.
